1. Acceptance of Terms

By downloading, installing, or using this application, you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use this app.

2. Age Requirement

You must be at least 13 years old to use this app. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you must have your parent or legal guardian's permission to use this app. Users in the European Union must be at least 16 years old.

3. User Accounts & Private Keys

You are solely responsible for:

• Securing and maintaining the confidentiality of your private keys
• All activities that occur under your account
• Any loss or compromise of your private keys

We cannot recover lost or stolen private keys. We have no access to your private keys or the ability to reset them. Never share your private keys with anyone.

4. User Responsibilities & Prohibited Conduct

You are solely responsible for all content you send, receive, and store through this app. You agree NOT to use this app to:

• Send or promote illegal content (including but not limited to drugs, weapons, child exploitation, terrorism)
• Harass, threaten, bully, or intimidate others
• Send hate speech or discriminatory content
• Send spam or unsolicited commercial messages
• Impersonate any person or entity
• Commit fraud or distribute malware
• Violate intellectual property rights
• Violate any applicable local, state, national, or international law

You acknowledge that you are solely responsible for any legal consequences arising from your use of this app.

5. Our Non-Responsibility

We explicitly are NOT responsible for:

• Any content sent or received by users
• Any actions taken by users
• Any illegal use of this app
• Any data loss or message delivery failures
• Any damages resulting from your use of the app
• The XMTP protocol or decentralized network operations
• Monitoring, controlling, or moderating user content

This is a decentralized messaging application. We do not store, control, monitor, or have access to your messages or content.

6. No Warranties

This app is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation
• Accuracy or reliability of results

We do not guarantee that the app will be secure, available at all times, or free from bugs or errors.

7. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any:

• Direct, indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or business opportunities
• Personal injury or property damage
• Damages arising from your use or inability to use the app

Our total liability to you for all claims shall not exceed the amount you paid to use this app (which is $0).

8. Third-Party Services

This app uses the XMTP (Extensible Message Transport Protocol), a third-party decentralized messaging protocol. By using this app, you also agree to comply with XMTP's terms and protocols. We are not responsible for the operation, availability, or security of the XMTP network.

9. Intellectual Property

The app's source code and design are protected by intellectual property rights. Users retain all rights to content they create and send through the app. The XMTP protocol is governed by its own open-source licenses.

10. Right to Modify or Terminate

We reserve the right to:

• Modify, suspend, or discontinue the app at any time without notice
• Update these Terms & Conditions at any time
• Refuse service to anyone for any reason

We have no obligation to maintain or support this app. Continued use after changes constitutes acceptance of modified terms.

11. Indemnification

You agree to indemnify, defend, and hold harmless the app developers, contributors, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the app
• Your violation of these terms
• Your violation of any laws or regulations
• Content you send or receive
• Your violation of any third-party rights

12. Governing Law & Disputes

These Terms & Conditions shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to conflict of law provisions. Any disputes arising from these terms or your use of the app shall be resolved in the courts of your jurisdiction.
